Many works tenders take the financial bid exclusive of GST and pay the tax over and above; others ask for an inclusive figure, in which case quoting exclusive makes you look cheaper than you are and costs you the difference. The rate depends on the classification of the supply, so where a contract mixes works and goods, confirm it with your accountant rather than assuming a single rate.

Quoting exclusive where the notice wanted inclusive makes you look cheaper than you are and you pay the difference out of margin.

The split follows the place of supply, not where your office is. Supply within the state of your registration is intra-state and splits into CGST and SGST at half the rate each. Supply into another state is inter-state and carries IGST at the full rate.

Works contracts for government are usually at 18 per cent, with some categories of civil work and some government supply at 12 or 5. The classification is a question for your accountant on a contract that mixes works and goods, not something to assume from the tender title.

Taking GST out of an inclusive figure means dividing by one plus the rate, not subtracting the rate. Eighteen per cent off an inclusive 1,18,000 is 18,000 of tax on a taxable value of 1,00,000, not 21,240.

Frequently asked questions

Should a tender bid be quoted inclusive or exclusive of GST?

Whichever the notice says, and it says one or the other. Where the bid is exclusive, the department pays GST over and above the quoted amount against a tax invoice. Where it is inclusive, the tax comes out of your quoted price. The comparison at evaluation is made on the basis the notice specified, so the mistake is not only expensive, it can make your bid non-comparable.

Is it CGST and SGST or IGST on a government contract?

It depends on the place of supply. Work executed in the state where you are registered is intra-state, so CGST and SGST at half the rate each. Work executed in another state is inter-state and carries IGST at the full rate, and for a works contract you may need registration in the state where the work is done. Confirm before you quote, because the difference affects your input credit position.

What GST rate applies to works contracts?

Most works contracts for government bodies attract 18 per cent, with concessional rates of 12 or 5 per cent for specified categories such as certain infrastructure and affordable housing work. Rates and the conditions attached to them change, so the safe practice is to confirm the classification for the specific contract rather than carrying forward what applied to the last one.
